The Chicago Faucet Company ("Chicago Faucets") extends to the original consumer the following warranties for Genuine Chicago Faucets manufactured products and components, or other components under other Chicago Faucets Warranties, (collectively, the "Products") used in commercial or residential applications:
The "Faucet," defined as any metal cast, forged, stamped or formed portion of the Product, not including electronic or moving parts or water restricting components, or other components covered under other Chicago Faucets warranties, is warranted against manufacturing defects for the life of the Product.
The "Cartridge," defined as the metal portions of any Product typically referred to by the product numbers containing 1-099XT, 1-100XT, 377XT, 217XT and 274XT, excluding any rubber or plastic components, is warranted against manufacturing defects for a period of five (5) years from the date of Product purchase. All Cartridges included in Chicago Faucet's Single Control or Shower Products are also warranted against manufacturing defects for a period of five (5) years from the date of Product purchase.
For Products used in commercial applications, the finish of the Product is warranted against manufacturing defects for a period of one (1) year from the date of Product purchase.
For Products used in residential applications, the finish of the Product is warranted against manufacturing defects for a period of five (5) years from the date of Product purchase.
All other Products not covered above are warranted against manufacturing defects for a period of one (1) year from the date of Product purchase.
The limited warranties described above do not apply in the event of Product failure or damage due to installation error, accident, abuse, misuse, improper care, cleaning or maintenance (including failure to follow Chicago Faucets care and cleaning instructions), unauthorized repair, extreme environmental condition or damage occurring during any shipment of the Products (claims must be presented to the carrier). In addition, the limited warranties only apply when the Products are used for the purposes and under conditions for which they are intended.
Unless otherwise provided by applicable law, Chicago Faucets' liability, if any for any defective Product shall be limited to repair or replacement of the Product, at Chicago Faucets' option, and Chicago Faucets shall not be liable for any damages, whether direct, indirect, incidental, consequential, special or otherwise (including, without limitation, damages for inconvenience or loss of use, revenue, profits or data) because of Product defects. Chicago Faucets will pay limited labor and material expenses required to repair a Product under warranty, but will not be responsible for any labor charges resulting from the installation or removal of the existing or replacement Products.
The warranty with respect to the products manufactured by another company, but which are sold by Chicago Faucets, is limited to the warranty extended to Chicago Faucets by such manufacturer.
EXCEPT AS PROVIDED ABOVE, EXPRESS WARRANTIES WITH RESPECT TO THE PRODUCTS OR COMPONENTS ARE HEREBY EXCLUDED.
FOR PRODUCTS USED IN COMMERCIAL APPLICATIONS, ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY EXCLUDED.
FOR PRODUCTS USED IN RESIDENTIAL APPLICATIONS, ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE LENGTH OF THIS WARRANTY.
The limited warranties provided herein shall not be deemed extended because of any repair or replacement hereunder, and the repaired or replaced Product or part shall be covered for the balance of the original warranty.
Chicago Faucets neither makes or assumes and does not authorize any other person to make or assume any obligation or liability in connection with any of its Products other than as covered by the limited warranties provided herein.
The following statements apply to Products used in residential applications only: Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state or jurisdiction to jurisdiction.
